Terms and Conditions

(1) Preamble Master’s Program / Certificate Course / Seminar

The Academy of the Ruhr-Universität gGmbH (hereinafter referred to as ‘Academy’) offers with various cooperation partners – faculties of the Ruhr-Universität Bochum, colleges and universities as well as associations – post-graduate master’s programs, certificate courses and seminars. The Academy is your contract partner for the execution of the post-graduate course (course) in the format of a degree course / certificate course / seminar certificate course/seminar; the particular faculty/cooperation partner is responsible within the framework of its own ‘examination regulations’ (degree program) for course content, examinations (degree program and certificate course) and graduation (degree program). The academy confers the certificate (certificate course or post-graduate course according to § 62 Hochschulgesetz NRW) and the certificate of attendance (seminar).

(2) Application and Conclusion of Contract / Registration

The participant’s course registration has to be done electronically via the registration form (PDF) or the Academy’s website. The registration is binding. The Academy will confirm receipt of the registration by sending a reply, which does not constitute a contract yet; the automatic reply only informs that the registration has been received. A contract is only concluded by the confirmation of registration, which the Academy sends via a separate e-mail. The Academy reserves the right to cancel the course before it begins by declaration to the participant, if a specified minimum number of participants is not reached. If an course is overbooked at the time of receipt of the registration the registrant will be informed immediately.

Master’s Program / Certificate Course / Seminar

The applicant / participant registers with the study application / registration for the master’s program / certificate course / seminar. The applicant/participant will be informed in writing about the result of the admission examination (study program) / the acceptance of the registration. Upon receipt of the confirmation letter, a legally effective study-contract / contract is concluded in accordance with these terms and conditions.

Master’s Program

At the same time, the application for admission to the study program is submitted. Based on the submitted documents, the responsible examination board for the study program examines the admission of the applicant to the study program in accordance with the provisions of the examination regulations. There is no legal claim to admission. The applicant must submit all documents required for registration and admission by the application deadline. The student shall be subject to the examination regulations of the respective study program.

Certificate Course

The Academy reserves the right to request additional documentation for certain certificate courses, check the requirements for admission, and, to reject an application, if applicable.

(3) Service / Participation in Courses

Master’s Program / Certificate Course / Seminar

The Academy agrees to provide teaching services as part of the study program/certificate course/event and all related services as described in the documents provided to present the study program / certificate course / event. The Academy reserves the right to make necessary changes in the approach of conducting. Furthermore the Academy reserves the right to appoint substitute speakers and / or additional speakers and to change the procedure of the study program / course, insofar this does not affect essential features of the course / certificate and the changes are reasonable for the students / participants.

Master’s Program / Certificate Course

The student has the right to participate in all in-class courses. If courses are missed, it is possible to resit. All required examinations must be passed successfully.

Master’s Program

The Academy is committed to ensuring, within its area of responsibility, that students are able to take the academic examination. Before the start of the study program, the academy informs the student about the procedure of (type, scope, place and dates) the study program’s 1st semester. Corresponding information for the following semesters will be announced in time. Participants are expected to attend all courses in all modules. In exceptional cases of not personally caused prevention, substitute solutions that allow the same learning objectives to be achieved can be agreed on with the approval of the chairperson of the examination board.

(4) Study- and Attendance Fee

Master’s Program / Certificate Course / Seminar

The study/participation fee is VAT-exempt according to § 4, No. 21 a bb) UStG.

Discount

If several employees of the same legal entity book the same course, the Academy grants a discount of ten percent on the course fee for the second and each additional person. If a person books more than one course at the same time, the Academy grants him/her a discount of ten percent on the lower course fee from the second course onwards. (Example: If a seminar and a multi-module course are booked at the same time, and the course fee of the seminar is lower than that of the multi-module course, the discount applies to the course fee of the seminar).

Master’s Program

The fee includes participation in the in-class courses, study materials, and the Semester Ticket, if this is indicated in the respective description, on the days of attendance, the implementation and evaluation of the academic performance and examinations, the supervision of the master thesis as well as the issuance of the certificates and diplomas. In the course of an extension of the study period by the student(s) an additional fee of EUR 500.00 per additional semester will be charged. For module and exam days which need to be made up, EUR 100.00 per module and examination day will be charged. The fee is to be paid before the beginning of the semester and is also VAT-exempt. In the case of exemption from participation in individual modules due to the recognition of previous academic performances and examinations in accordance with § 12 of the Examination Regulations, there is no discount on the study fee.

If the study fee is not paid in full, the certificate will not be issued. A certificate of attendance will be issued.

Certificate Course

The fee includes participation in the in-class courses, the materials, catering, if this is indicated in the respective description, on the days of the course, the implementation of the course, the examination, the support as well as the issuance of the certificate.

If the study fee is not paid in full, the certificate of advanced studies will not be issued. Only a certificate of attendance will be issued.

Seminar

The fee includes the participation documents, the implementation, the support as well as the issuance of the certificate of participation. If the fee is not paid in full, the certificate of attendance will not be issued.

Exclusion right

If the payment of the participation fee is not made in time at the due date, the Academy reserves the right to exclude the person from the course until payment is made in full without the obligation to pay being cancelled. Until the course fee has been paid in full the Academy has a right to retain the confirmation of participation or the certificate.

(5) Cancellation of Courses

Master’s Program / Certificate Course / Seminar

The Academy reserves the right to cancel the study course / seminar for organizational or other reasons. This is particularly the case if the minimum number of participants is not reached or if the course/event cannot be implemented for reasons of force majeure or impossibility. In this case, any study / participation fees already paid will be refunded; further claims do not exist.

(6) Cancellation / Withdrawal

Cancellation must be submitted in a written form. The date of cancellation is the date of receipt by the Academy. For the student/participant, the cancellation of the concluded study contract/agreement is possible with following terms and conditions:

Master’s Program

a) cancellation is possible free of charge up August 1st with the normal price or July 15th with the early-bird discount;

b) in case of a cancellation up to three weeks before the beginning of the study program, 30% of the study fee will be charged;

c) in case of a later cancellation and after the beginning of the study program, 50% of the tuition fee prorated for the remaining study program will be due.

Non-attendance does not release the student from the obligation to pay. If the student nominates a substitute participant approved by the examination board by the start of the course or if the place vacated by the student’s withdrawal is filled by the Academy before the start of the course the flat-rate fee will not apply.

Certificate Course / Seminar

a) a cancellation is possible free of charge up to four weeks before the start of the course;

b) in case of a cancellation up to two weeks before the start of the course, 30% of the participation fee will be due;

c) in case of a later cancellation and until the beginning of the course, 50% of the participation fee will be due;

d) thereafter, the full participation fee is due.

If the cancellation occurs after the start of the course or if the course is not attended, the full participation fee is also due. Non-attendance does not release the participant from the obligation to pay. After consultation, it is possible to name a substitute participant, if the substitute participant fulfills the necessary participation requirements.

(7) Disclaimer

Master’s Program / Certificate Course / Seminar

The Academy is not liable for the loss, damage or destruction of property of the student/participant in connection with the implementation of the study course/seminar, unless this can be traced back to gross negligence or intent on the part of the Academy and its commissioners.

Other further claims do not exist, except in the case of injury to life, body or health, insofar as these are based on gross negligence or intent.

In particular, we do not accept any liability for any damage resulting from the application or transfer of the learned or imparted within our courses.

Insofar as the student/participant is not otherwise legally insured against accidents, he/she will be accident insured through the Academy during the time of the attendance courses.

(8) Privacy Information

Master’s Program / Certificate Course / Seminar

a) The Academy collects and processes personal data of the course participants in the context of the implementation of the course contract. This serves the implementation of the event. The personal data will – only as far as necessary to implement the course – be passed on to third parties, e.g., the name of the course participant will be passed on to the teaching staff.

b) The course participant may at any time, free of charge, inspect or obtain written information about his/her data stored at the Academy and decide for him/herself which data, if any, should be deleted.

c) Regarding the consent of the course participant and further information on data collection, processing and use, we refer to the data protection declaration, which is available in printable form on the website https://www.akademie.rub.de/ at any time by clicking on the “Data protection declaration” button. The deletion of the data can only take place when there are no longer any legal obligations to retain data.

d) Without the consent of the course participant, the Academy will not use the course participant’s data for the purposes of advertising, market or opinion research.

e) The Academy makes film and photo recordings for public relations purposes at regular intervals. Each participant has the right to revoke his or her consent to the use of his or her photographs, images, or sound recordings in writing at any time.

f) The Academy produces evaluations and research reports on teaching-learning processes at regular intervals as part of its quality management and continuous improvement process. These records do not contain personal data. Each participant has the right to revoke his or her consent to the storage and use of this data in writing at any time.

(9) Copyright and Copyright Law

Master’s Program / Certificate Course / Seminar

The documents provided as part of the study program/seminar are and remain the intellectual property of the Academy or the respective author. They can be used for personal purposes of those persons who participated in the study program/seminar. Unless otherwise stated in the respective content, any use beyond the free use of the work and thus any use of all documents of the Academy that is contrary to the provisions of copyright law is not permitted without the express written consent of the Academy or the respective author.

(10) Ideological, party-political or economic advertising

The participant does not promote his or her ideological, party-political or economic worldview during the course.

(11) Final Provisions

Master’s Program / Certificate Course / Seminar

Details on the implementation of the study program/seminar are contained in the study/event information which the student/participant has received and taken note of. The student/participant must immediately notify the Academy in writing of any changes to his/her name, address, and billing address. If no notification of change is made, documents shall be deemed to have been delivered if they were sent to the address or billing address last provided by the student/participant. In the case of degree and certificate courses, the Academy reserves the right to check all written work submitted by the student for plagiarism.Should any provision of this agreement be wholly or partially invalid or later lose its legal effect, this shall not affect the validity of the remaining provisions. Instead of the invalid provision, the statutory provisions shall apply.

The law of the Federal Republic of Germany applies

(11) Final Provisions

Details on the implementation of the study program/seminar are contained in the study/event information which the student/participant has received and taken note of. The student/participant must immediately notify the Academy in writing of any changes to his/her name, address, and billing address. If no notification of change is made, documents shall be deemed to have been delivered if they were sent to the address or billing address last provided by the student/participant. In the case of degree and certificate courses, the Academy reserves the right to check all written work submitted by the student for plagiarism.Should any provision of this agreement be wholly or partially invalid or later lose its legal effect, this shall not affect the validity of the remaining provisions. Instead of the invalid provision, the statutory provisions shall apply.

The law of the Federal Republic of Germany applies

(12) Right of Revocation for Consumers / Private Persons

Master’s Program / Certificate Course / Seminar

You may revoke your study program/registration within two weeks after receipt of the admission/registration confirmation, but in the case of services not before the day of the conclusion of the contract. To comply with the revocation period, it is sufficient to send the revocation in time. The revocation is to be addressed to: Academy of the Ruhr-Universität gGmbH, Suttner-Nobel Allee 4 (Opelring 1) 44803 Bochum, e-mail: info@akademie.rub.de.

In the event of an effective revocation, we will refund any study/participation fees already received. For this repayment, we will use the means of payment you used, unless expressly agreed otherwise with you.

If you have participated in courses at your own request during the cancellation period, you must pay us a reasonable, pro rata amount for participation up to the time at which we receive your cancellation.

(13) Severability Clause

The contract shall remain binding in its remaining parts even if individual clauses are legally invalid. The invalid clauses shall be replaced by the statutory provisions. Insofar as this would represent an unreasonable hardship for one of the contracting parties, however, the contract as a whole shall become invalid.
